James SMALE - (Died abt. 1812)
James SMALE
lived in North Devon and was a yeoman. His date of birth is unknown, however, he married
Thomasine FRENCH on 27th June 1779 at St Mary's Church, Black Torrington, Devon. The couple had seven known children, six boys and
finally a girl.
Sadly Thomasine died in 1803 and James married Mary
COOPER in St Michael's Church, Shebbear, on 3rd July 1804.
On 21st October 1811, James made a will and appointed
two of his sons, Edward and Richard, as his executors. The will reads as
follows...
In the Name of God Amen the twenty first day of October 1811 James Smale Yeoman of the Parish of Shebbear in the County of Devon being very sick and weak in Body but of proper Mind and Memory thanks be given unto God
. Unto Mind the Mortality of my Body and knowing that it is appointed for all Men once to die do make and ordain this my last Will and Testament that is to say Principally? and first of all I give and accomend [I commend] my Soul into the hands of Almighty God that gave it and my Body I recommend? to the Earth to be buried in a decent Christian Burial at the Direction of my Executors nothing doubting but at the General Resurrection I shall receive the same again by the Mighty Power of God and as touching such
. Estate wherewith it hath pleased God to bless me in this Life I Give Devise and dispose of the same in the following manner and form. Imprimis I Give and Bequeath to my well beloved wife Mary Smale I Give Thomas? Ward? Hous? and the

and the Chest and the Chest of Drawers and she is to have all her own Thinge? that she brought with her and she is to have forty Pounds and she is to have teen [ten] Pounds in one Month after my Decease and teen [ten] Pounds a year after until that the forty Pounds is all pead [paid] and if that she doth not live to expend what that I gave her she is to
it to any of my Children whome that she will Item I Give to my well beloved Son James Smale five shillings to be pead [paid] one year after my Decease Item I Give to my well beloved Sons John Smale Thomas Smale and William Smale teen [ten] Pounds each to be paid one year after my Decease Item I Give to my well beloved Daughter Mary Smale thirty Pounds to be paid when that she comes to the age of twenty one years 21 years and I put John Smale my Brother in Trust and Garden [guardian] for her and she is to have In Trust for the Money untill comst? of age but if that she should die before that time the Executors is to have the Money Item I Give to my well beloved Sons Edward Smale and Richard Smale whome I likewise constitute make and ordain my sole Executors of this my last will and Testament all and singular my Good and Chattels by them freely to be possessed and Enjoyed and I do hereby utterly disallow revoke and discount? all and every other former Testament Will Legacies and End Bequests and Executors by one in any way before named willed and bequeathed ratifying and confirming this and no other to be my last will and Testament and I put in John Griffin in Trust? that if that two Executors cant agree that the said John Griffin is to get
