Daniel BAILEY - (died 1808)

Daniel BAILEY married Ann WORGAN in 1778, the details in the Rockhampton parish registers, as transcribed by www.scribes-alcove.co.uk, are as follows...

Both at the time of his marriage and when he made his will, Daniel lived in Cowley, Gloucestershire - further investigation is required to discover if he was also born there. According to his will, signed on 9th May 1808, he was a timber merchant. His sole executrix was his wife, Ann, and the will was proved on 29th October 1808.

There is no evidence this couple had any children. However, they seem to have had links with Ann's nephew, Benjamin PITCHER, the younger (born abt. 1775 - son of Ann's sister, Margaret and her husband, Benjamin PITCHER, the elder). Benjamin and his wife, Sarah RICE, named two of their children, Ann Bailey PITCHER and Daniel Bailey PITCHER. These two children were born shortly after Daniel BAILEY died. Perhaps the fact that Benjamin was named as a beneficiary in Daniel's will prompted the choice of names or maybe Benjamin had already developed close bonds with his uncle and aunt and wanted to name his children in honour of them. Ann appears to have been buried in Coaley in 1823 - this was Benjamin's local church.

Daniel BAILEY'S will reads as follows...

By the Permission of Almighty God I Daniel Bailey of Cowley in the County of Gloucester Timber Merchant Do hereby revoke all Wills Codicils and other Testamentary Dispositions by me at any Time heretofore made and do declare this to be my last Will and Testament I Give and Devise unto my beloved Wife Ann Bailey All That my Messuage Tenement or Dwelling House Garden Ground Shops and Buildings with the Appurtenances thereto belonging situate and being at Cowley aforesaid late in my Occupation but now in the Occupation of Thomas Adey To hold the same unto and to the use of my said Wife Ann her Heirs and Assigns for ever Also I Give unto my said Wife Ann All That Leasehold Cottage or Tenement with the Garden and Appurtenances thereto belonging situate at near a Place called Cowley Pike in the Parish of Cowley aforesaid together with the Close of Meadow or Pasture Ground thereto adjoining containing together by Admeasurement Two Acres and Twenty Eight Perches (be the same more or less) now in the Occupation of Thomas Cam and Thomas Savage To hold the same unto my said Wife and her Assigns for and during the Term of her Natural Life And from and after her Decease I Give the same Leasehold Premises unto Benjamin Pitcher of Uley in the County aforesaid Yeoman his Executors Administrators and Assigns for and during all the Residue of the Term which may be to come therein at my said Wife’s Decease Also I Give unto my said Wife Ann All Those Two Leasehold Closes of Pasture Ground situate lying and being at Cowley aforesaid now in my Occupation called by the several Names of Bethworthy Piece and Peters Close containing together five Acres Three Roods and Nine Perches (be the same more or less) To Hold the same to my said Wife and her Assigns for and during the Term of her Natural Life in Case the Estate Term and Interest I have therein shall so long endure And from and after her Decease I Give the said Two last mentioned Cloves of Pasture Ground unto the said Benjamin Pitcher his Executors Administrators and Assigns for and during all the Residue of the Estate Term and Interest which may be to come therein at my said Wife’s Decease Also I Give unto the said Benjamin Pitcher All those Parcels of Leasehold Wood and Wood Ground called Cowley’s Wood situate and lying within the Parish of Cowley aforesaid containing by Estimation Forty Four Acres (be the same more or less) To hold the same unto the said Benjamin Pitcher his Executors Administrators and Assigns for and during all the Estate Term and Interest I have therein Also I Give unto my said Wife All That Cottage or Tenement (now divided into Three Tenements) with the Garden thereto adjoining and belonging containing together by Estimation One Quarter of an Acre or thereabouts (be the same more or less) situate at Cowley aforesaid within, and Parcel of the Manor of Cowley aforesaid and now or late in the Occupation of Sarah Savage and which I hold by Copy of Court Roll under the Earl of Berkeley To hold the same unto my said Wife and her Assigns for and during the Term of her Natural Life And from and after her Decease I Give the same premises unto Giles Andrews of Cowley aforesaid Yeoman To hold to him his Executors Administrators and Assigns for and during all the Estate Term and Interest which may be to come therein at the Time of my said Wife’s Decease Also I Give and Devise unto my said Wife Ann All That Piece of Pasture Ground or Wood and Woodland Ground called James Hurno?? otherwise Meadbridge Grove containing by Estimation One Acre with all Timber and other Trees growing or being therein situate and being in the Parish of Cowley aforesaid To hold the same unto and to the Use of my said Wife her Heirs and Assigns for ever Upon Trust that she my said Wife do and shall so soon as conveniently may be after my Decease absolutely sell and dispose of the same by Public Auction for the most Money or best Price that can or may be gotten for the same and pay and apply the Money arising by such Sale for and towards paying and discharging the several Legacies herein after given And my Will is That upon the Sale of the same Piece of Pasture Ground or Woodland Ground the Receipt of my said Wife her Heirs or Assigns for the Consideration Money shall be a good and effectual Discharge to the Purchaser or Purchasers of the same Premises And that such Purchases or Purchasers after such Receipt or Receipts shall not be obliged to see to the Application of the Money by him or her or them respectively paid or be answerable or accountable for any Loss Misapplication or Nonapplication of such Purchase Money or any Part thereof I Give unto the Children of Thomas Savage the Elder of Cowley aforesaid Yeoman the Sum of Thirty Pounds to be equally divided between them and the Survivors of them on their attaining the Age of Twenty One Years which Sum I Will shall be paid unto the Hands of their said Father for their Use by my Executrix herein after named within Twelve Calendar Months next after my Decease Whose Receipt shall be a sufficient Discharge for the same Also I Give unto the Children of Daniel White of Cam in the County aforesaid Butcher by Sarah his wife who before her Marriage was called Sarah Savage the Sum of Fifteen Pounds equally to be divided between them and the Survivors of them on their attaining the Age of Twenty One Years Which Sum I Will shall be paid unto the Hands of their said Father for their Use by my Executrix herein after named within Twelve Calendar Months next after my Decease whose Receipt shall be a sufficient Discharge for the same Also I Give to Sarah Wife of Mr Edward Poulton of King Stanley Yeoman the Sum of Thirty Pounds Also I Give unto Daniel Savage of Cowley aforesaid Pig Dealer the Sum of Ten Pounds Also I Give unto his Sister Margaret Hull?? The Sum of Twenty Pounds Also I Give unto Mrs Jane Horwood of Frocester Widow the Sum of Fifteen Pounds Also I Give unto Alice the Wife of John Boulton of Woodchester in the County aforesaid Yeoman the Sum of Ten Pounds Also I Give to Elizabeth Andrews of Cam’s Green in the Parish of Cam aforesaid Spinster the Sum of Ten Pounds Also I Give unto my Servant John Andrews the Sum of Ten Pounds Also I Give unto the Chidren of the said Giles Andrews the Sum of Thirty pounds to be equally divided between them and the Survivors of them on their attaining the Age of Twenty One Years Which Sum I Will shall be paid unto the Hands of their said Father (for their Use) by my Executrix herein after named within Twelve Calendar Months next after my Decease whose Receipt shall be a sufficient Discharge for the same Also I Give unto Thomas Andrews and Richard Andrews both of Cam aforesaid Yeomen The Sum of Ten Pounds each Also I Give unto Mr Charles Jackson the Elder of Uley aforesaid Stone Mason the Sum of Ten Pounds Also I Give unto the said Benjamin Pitcher the Sum of Twenty Pounds Also I Give unto my Servant Abraham Robins the Sum of Five Pounds Also I Give unto Martha the Wife of George Werrett of Frocester aforesaid the Sum of Five Pounds Which said several Pecuniary Legacies I Will and Direct Shall be paid by my Executrix herein after named within Twelve Calendar Months next after my Decease All the Rest and Residue of my Monies Securities for Money Stock in Trade Book Debts and all other my Personal Estate of what Nature or Kind soever I Give and Bequeath unto my said Wife Ann Bailey to and for her own Use and Benefit And I do hereby Nominate Constitute and Appoint my said Wife Executrix of this my last Will and Testament In Witness whereof I the said Daniel Bailey the said Testator have to this my last Will and Testament written and contained in this and the two preceding Sheets of Paper set my hand and Seal (that is to say) to the two preceding Sheets hereof I have subscribed my Name and to this third and last Sheet have set my Hand and Seal this Ninth Day of May in the Forty Eighth Year of the Reign of our Sovereign Lord King George the Third And in the Year of our Lord One Thousand Eight Hundred and Eight
